Event Participation Terms and Conditions
The following terms and conditions (“Terms”) govern your participation in the conference, summit, event, meeting, workshop, Online Event (as defined below) or other event (each an “Event”) operated and hosted by Atera Networks Ltd. (“Atera”, “us” “we”). Please read the following Terms carefully before subscribing to the Event, so that you are aware of your legal rights and obligations with respect to the Event. By subscribing to the Event or otherwise attending the Event, you expressly acknowledge and agree that you are entering into a legal agreement with us and have understood and agree to comply with, and be legally bound by, these Terms. If you do not agree to be bound by these Terms please do not attend, access, subscribe to, or otherwise participate in the Event.
- Registration: In order to register to an Event, you must be at least 18 years old, and will be required to fill in the Event registration form, and provide us with accurate and complete registration information, which include certain information and personal information, such as your full name, email address, telephone number, company you work at and position (“Registration Information”). Atera may use your Registration Information in order to register you to the Event, for administration purposes, in order to send you with updates and feedback regarding the Event, in order to invite you to future Events, and for its marketing purposes. When registering to an Event, you may be asked to verify your identity, Atera reserves the right to reject registrants who fail to verify their identity when requested. You hereby undertake to provide us with accurate updated and complete Registration Information. If you register for an Event as a representative of a company or other organization you confirm that you have authority to agree to these Terms on behalf of such company or other organization. Your participation in the Event is subject to availability and to acceptance by Atera at its absolute and sole discretion.
- Your Obligations: You shall comply with the rules, policies, codes of conduct and instructions of Atera and/or anyone on its behalf.
- Intellectual Property:
- Content. Unless otherwise indicated, Atera (and/or any other presenter/speaker as applicable) owns copyright for the content, documents, audio, recordings, data, information and/or any other material presented in the Event (“Content”). An online, virtual or non-physical Event (“Online Event”) may be viewed by you only; and may under no circumstances be modified, republished, recorded reproduced, or otherwise be made publicly available, unless explicitly authorized by Atera (and/or any other presenter/speaker as applicable).
- Event Footage. By attending the Event you acknowledge and agree that photographing, filming and recording may take place at the Event, and that Atera reserves the right, at its absolute discretion, to use such images, photographs, videos and recordings for its business purposes, and in future marketing and/or promotional materials, including social media platforms and websites, without obtaining any further approval, and/or any obligation to add any credit or mention your name.
- Feedback. We appreciate hearing from our Event attendees and welcome your comments, ideas input and suggestions regarding the Event (“Feedback”). You hereby acknowledge and agree that we may use the Feedback freely and without any restriction of any kind, for any purpose whatsoever, without compensation or credit to you or any other person.
- User Generated Content: You may be invited to participate in the event and share content, suggestions and ideas with the attendees, in addition, the Event may include discussions and discussion groups, of if this is an Online Event virtual or physical meeting rooms, chats and other forums enabling interaction between attendees. Atera does not control and is not responsible for any information and/or materials shared or posted by you or any attendee (“User Generated Content”) and cannot guarantee the accuracy of such User Generated Content. You may not, share, post, publish, link to, upload, send or distribute any information which: (a) is offensive, threatening, abusive, hateful, inappropriate, fraudulent or violates any law; (b) is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights; or (c) is malicious constitutes or contains a virus or other harmful component or malware.
- Disclaimers: Atera is not liable for any Content of the Event, quality or accuracy of the presentation or if your learning outcomes did not entirely meet your expectations. The Event and Content are provided on an “as is” and “as available” basis, for reference purposes only, for your general information and are not intended, nor should it be used as, a substitute for professional advice with respect to subject matter thereof or for any particular use case or circumstances. You agree that your participation in the Event and your use of any Content is at your sole and entire risk and responsibility, and that Atera shall not be liable for any loss, cost or damage suffered directly or indirectly by a you, which may be incurred by you in relation to any aspect of the Event (including without limitation cancellation, unavailability or difficulty to connect to an online Event) and/or any Content.
- Changes to Events: Atera may, at its sole discretion, change or modify the Event or any aspect of it, including a change from a physical Event to an Online Event, change in venue, Content and/or timing of the Event. Atera shall use reasonable efforts to notify all registered participants of any changes prior to the Event.
- Recordings: The Event may include a feature that allows audio and any Content exchanged or viewed during the Event to be recorded by Atera or a third party on its behalf. By attending the Event you acknowledge and agree to the recording.
- Limitation of Liability: ATERA SHALL NOT BE LIABLE (WHETHER UNDER CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY) FOR ANY INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING, ANY LOSS OR DAMAGE TO BUSINESS EARNINGS, LOST PROFITS OR GOODWILL, SUFFERED BY ANY PERSON, ARISING FROM AND/OR RELATED WITH THESE TERMS AND/OR THE EVENT, EVEN IF ATERA IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ATERA’S LIABILITY UNDER, ARISING OUT OF OR RELATING TO THESE TERMS AND/OR THE EVENT, SHALL NOT EXCEED $100 USD.
- General. Atera reserves the right to discontinue or modify any aspect of the Event at any time. These Terms and the relationship between you and Atera shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its principles of conflict of laws. You agree to submit to the personal and exclusive jurisdiction of the courts located in Tel Aviv-Yaffo, Israel and waive any jurisdictional, venue, or inconvenient forum objections to such courts. These Terms shall constitute the entire agreement between you and Atera concerning the Event. If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and a party’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. If you do not wish to accept the amended terms, please do not attend the Event.
